Supplemental Educational Services could occur during school day
From the Texas Education Agency:
Section 1116(e)(12)(C) of the ESEA defines SES as “tutoring and other supplemental academic enrichment services that are . . . in addition to instruction provided during the school day.” Therefore, a provider may not provide SES during any time a student would otherwise be receiving instruction, and may not substitute SES for any instruction a student would otherwise receive.
USDE recently released an interpretation that it would be allowable to offer SES during such non-instructional periods as lunch, study hall, or homeroom. For eligible high school students who attend classes for only a part of the school day, it would also be allowable for providers to offer SES at other times during the school day when these students are not enrolled in or attending classes.
A letter on this new interpretation was mailed to LEAs on Friday, Sept. 18.
