SB 139

Status: Sent to governor
Author: Sen. Jose Rodriguez
Sponsor: Rep. Joe Moody
Summary: Requires TEA to develop a notice for posting on the TEA website and distributing to districts that indicates the change made from 2016 to 2017 in reporting requirements for districts and charter schools regarding the special education representation indicator, along with the rights of a child under state and federal law and the process for initiating an evaluation for special education services. Districts and charter schools must include in the notice information on where local processes and procedures for initiating a referral for evaluation can be found.

The commissioner will establish a date by which each district/charter must provide notice to the parent of each child in the district, available in English and Spanish, with a good faith effort to provide it in another language spoken by the parent if necessary. The provision expires Sep. 1, 2023.
